The following agreement is entered into by the breeder and owner/s listed within this contract. All parties assent feline has been seen prior to purchase in person or by video call and is in healthy, satisfactory condition for purchase and transfer.

Terms and Conditions

Jurisdiction for this agreement shall be interpreted in accord with the laws of the state of Pennsylvania. Venue action related to this agreement shall be brought before the Superior court of the state of Pennsylvania. Owner/Buyer assents to personal jurisdiction within such venue and any judgement obtained will be enforceable within the jurisdiction in which Owner/Buyer resides as if obtained within that jurisdiction.

1.) Felines purchased as Pet that are placed with Owner/Buyer unaltered (non-sterilized, not spayed or neutered) must be spay or neutered on or before date specified below. (On or before six months old for kittens) This is the Owner/Buyers responsibility to schedule on time, have completed and provide satisfactory Veterinarian proof procedure was performed by contracted date in the form of a verifiable spay or neuter certificate including Veterinarian’s name, address and phone number along with permission to call and verbally verify, if desired by Breeder/Seller. Registration papers will be USPS mailed out once altering has been satisfactorily verified by Breeder/Seller. Failure to complete contracted task on time agreed will result in a penalty of $3,000.00 each week that passes. (See Exclusions and Amendments)

2.) Owner/Buyer agrees to provide a lifetime, safe, responsible, caring home for adopted feline. Feline is to remain, be maintained and cared for within the household of the contracted Owner/Buyer.

Breeder/Seller reserves the first right of refusal should feline not work out in contracted home and need to be rehomed. Contact your Breeder/Seller immediately for further instruction.

Under no circumstances shall this feline be placed with any rescue, pet store, research laboratory or similar facility, loaned, leased, gifted, traded, transferred, given or resold without breeder’s prior knowledge and expressed permission. Owner/Buyer agrees to contact Breeder/Seller before allowing feline to leave their possession should they no longer want responsibility of feline. At Breeders/Sellers discretion, Breeder/Seller may request contracted feline back and contact other individuals interested in it.

Permission to transfer this feline or its ownership to anyone other than contracted Owner/Buyer is not guaranteed and is also at the discretion of the Breeder/Seller. In the event the current Owner/Buyer gets prior Breeder/Seller approval to transfer feline, the new Owner/Buyer must be pre-approved, before permission and possession is granted. The new Owner/Buyer must sign a Sales Contract like this one and be agreeable to all the terms and conditions within. If not agreeable, transfer will not be possible, feline is to be returned to Breeder/Seller.

3.) Feline is not to be caged unless discussed and agreed on with the Breeder/Seller.

4.) Feline is to be an INDOOR ONLY cat, this means always kept indoors, not allowed to go outside to defecate or urinate and come back in or roam freely outside, with or without supervision. This also includes on a leash, harness or tie. This is for your feline’s safety and is mandatory.

5.) Feline may not ever be declawed or have tendonectomy surgery of any kind, for any reason.

6.) Feline is to be given proper medical care, per condition. Have regular checkups and immunizations as needed to remain healthy.

7.) Feline will be fed high quality food and always have fresh water available daily. (See Diet and Feeding Recommendations)

8.) Owner/Buyer will inform Breeder/Seller if this feline ever develops any serious or major health issues.

9.) Owner/Buyer will inform Breeder/Seller of any changes of address, phone and email.

Health and Maintenance

Immunizations not requiring a veterinary license sometimes are given by Breeder/Seller. Breeder/Seller’s veterinarian gives 2nd distemper and rabies shots. Initial shots do not include the Feline Leukemia vaccine. Any new felines brought into our home are checked for Feline Leukemia upon arrival. Therefore, I don’t feel the need to test each feline that leaves in a new home. If Owner/Buyer specifies they want their feline tested, agrees to pay Breeder/Seller’s extra fee, Breeder/Seller’s veterinarian shall perform requested tests.

A minimum of two distemper immunizations will be given to each kitten prior to leaving depending on age. They shall be (FVRCP), a 3 in 1 shot which consists of Feline Viral Rhinotracheitis (FVR), Feline Calicivirus (FCV) and Feline Panleukopenia Virus (FPLV).

Adult felines will be updated according to their current shot schedule before being placed.

Kittens: For the first year, a total of 3 distemper shots are recommended for optimal protection, at intervals no closer than every 3 to 4 weeks apart, beginning around 8 to 10 weeks old and 1 rabies shot at 3 months old (when and where mandatory).

Adults: A yearly distemper shot and every 3 years rabies boosters are recommended to maintain your feline’s health for the rest of its life.

Breeder/Seller doesn’t recommend feline be vaccinated for FIP (Feline Infectious Peritonitis) or Corona Virus at this time. Breeder/Seller believes this shot is dangerous and could kill your feline. Your feline will not be replaced if this happens as result of getting this shot. You will be acting negligent and in violation of this contract agreement. (see Exclusions and Amendments)

Some immunizations expose your feline to chemicals that can do more harm than good, while others can cause injection site sarcomas. If you decide to have shots administered that are unnecessary, against Breeder/Seller recommendation, regardless of your veterinarian recommendation, your feline could die, and it will not be replaced. Consult your Breeder/Seller first.

Diet and Feeding Recommendations

Kittens: Kittens from the age of weaning are fed ¼ – ½ of a 5.5 oz can each, of high quality pate wet food. (We feed Nulo, Halo or Orijen pate for example.) For the best results, kittens are to be fed this diet and amount for up to 1 year of age. Unless directed otherwise by Breeder/Seller or veterinarian. Kibble food may be added after kittens go home but is not necessary or recommended.

Adults: Between the ages of 1-7 years are fed a diet consisting primarily of a high quality pate wet adult food, ½ – ¾ 5.5 oz can every 12 hours, daily. Nulo, Halo or Orijen pate wet for example. Each cat requires different calorie intake based on activity, the advice of your Breeder/Seller or veterinarian is suggested maintaining ideal weight.

If you choose to feed something different than we do, we can make sure your feline is started out and fed according to your wishes before going home. You will be asked to provide the food you wish your feline to be fed.

Return Policy

Owner/Buyer has 72 hours in which to decide if contracted feline will be compatible in their home. During that time, feline must be kept isolated from other animals within the household and fed as documented above. Within this time frame, felines are to be checked by a licensed veterinarian of Owner/Buyers choice. If found to be unacceptable, at Breeder/Seller’s digression, feline must be returned to the Breeder/Seller. Feline is to be in same condition in which it was placed with Owner/Buyer. Before any veterinary care has been administered or sought except standard checkup. Upon return in same condition as delivered, feline may be exchanged for another feline then or at a later date, when available. After the 72-hour compatibility time has passed Breeder/Seller is under no obligation to compensate Owner/Buyer.

Refunds

No refunds (Unless at Breeder/Seller’s discretion.) Deposits are 100% non-refundable. A rehoming/reselling fee of 25% of the purchase price will be withheld if a refund is given. Refunds shall not exceed purchase price. Refunds are payable upon reselling of feline. Breeder/Seller will not pay for or refund any transportation, veterinarian check or recheck fees, spay, neuter, microchipping or legal paperwork fees for this feline or any replacement feline. Owner/Buyer, upon returning feline, is responsible for any necessary health certificate, transportation, veterinarian visits, or treatments. If Breeder/Seller opts to have a FeLV/FIV test performed before feline is returned, it must be dated within 3 days of returning the feline.

Replacement

Breeder/Seller retains the right to refuse the return of sick or infectious felines or until feline is well. If contracted feline is ever suspected to have Feline Infectious Peritonitis (FIP), Owner/Buyer must notify Breeder/Seller at once. Before any countering treatment or procedure is given. If it’s believed your feline died from Feline Infectious Peritonitis (FIP), accepted proof of Feline Infectious Peritonitis (FIP) shall be made ONLY by necropsy report at Owner/Buyers expense. Cause of death must be determined by a licensed Veterinarian to be Feline Infectious Peritonitis (FIP), not speculated. Feline will be replaced at Breeder/Seller’s digression upon results, then or at a later date as per Breeder/Seller’s replacement availability. Feline taken back by the Breeder/Seller because of negligence or improper care will not be subject to the above stated refund or replacement. Breeder/Seller’s liability to the Owner/Buyer shall never exceed purchase price of feline.

Exclusions and Amendments

If Owner/Buyer is found to be in violation of any of this contract, Breeder/Seller retains the option to sue the Owner/Buyer in Pennsylvania for breach of contract and requires immediate, unconditional return of contracted feline to Breeder/Seller. Any contractual dispute will be tried in Pennsylvania. Owner/Buyer agrees to pay all court costs, traveling expenses and attorney’s fees upon judgment for Breeder/Seller.

Should Breeder/Seller wave option to sue, failure to honor contract by Owner/Buyer shall result in the penalty of three thousand dollars for each week that passes, for each breach of contract. Payable to Breeder/Seller. All legal fees and court costs necessary to enforce this contract will be paid by the Owner/Buyer including those incurred by the Breeder/Seller and shall be reimbursed to the Breeder/Seller. Should any part of this contract be found to be illegal or invalid or unenforceable in a court of law in the United States of America or Canada, sale to be instituted in same, the entirety of this contract is still to remain valid and enforceable. Inasmuch as the below signed Owner/Buyer have read and understood the terms and restrictions of the purchase and understand that this sales contract is a legal and binding agreement, a legal document, enforceable within the confines of the United States of America and Canada that the costs incurred in interstate litigation by the Breeder/Seller are within the accepted responsibilities of the Owner/Buyer, this contract is a legal, effectual and enforceable document within and by all of the boundaries of the United States and Canada. In signing below, we, the Owner/Buyer, agree to abide by this contract or the penalties listed therein with be enforced and restitution to the Breeder/Seller as stated.

This Sales Contract includes the above-mentioned feline, CFA or TICA registration papers to be provided upon satisfactory proof of spay/neuter of pets to Breeder/Seller, as stated above, a health certificate (if needed) and a health record. This purchase is not negotiable at a later time, any amendments to this contract after the date of signing must be obtained in writing and approved by signature from the Breeder/Seller.

In the event feline Owner/Buyer are unable or unwilling to continue to care for contracted feline, found to be neglectful, negligent, in violation of contract or abusive. Owner/Buyer must surrender feline to Breeder/Seller immediately, unconditionally, acknowledging no refund or replacement of any kind will be made by Breeder/Seller.

Appendix

Pet – A domestic animal kept for companionship or pleasure. For pet quality, no guarantee is given to show ability, only to breed representation. (All pets mandatory to be spayed or neutered by contracted date.)

Show or Exhibit – Meets or exceeds breed standard to be entered into feline competition publicly for purposes of judging breed confirmation and exhibiting of the breed. No guarantee is given to temperament or show ability.

Breeder – Meets and exceeds breed standard. Permission is given to breed the Manx from Karello Cattery to contracted buyer only. No guarantee to offspring quality is given. All offspring are not to be placed unaltered within 2 generations from contracted Karello Cattery parent.
